My fiance is married to a Filipino man in Davao on paper, although they have been separated for 12 years. She then went to work in Japan and married a Japanese national there. However, the Japanese court found out that it was a fake marriage and deported her from Japan. On her cenomar, it shows 2 marriages. One is the Filipino man in Davao and the other is to the Japanese National. The Japanese national has already filed for divorce and the divorce was granted by the Japanese court. She recently just got the paperwork from the Japanese court system which proves that she was divorced from her ex Japanese husband. If she presents this paperwork from the Japanese court system to the court in Manila, could she be charged with Bigamy? Since has 2 marriages on her Cenomar? Please let me know. Thank you.
Essentially what I’m asking of you is after reading the story of my finance. Did she violate the bigamy laws of the Philippines?

May 5, 2025 at 8:03 pm #20541Your fiancée cannot be charged with bigamy if she can prove that her Japanese marriage was legally annulled/divorced under Japanese law and subsequently recognized by a Philippine court (via a petition for judicial recognition of foreign divorce under the Family Code), as the Philippines does not automatically recognize foreign divorces for Filipino citizens unless properly validated. (Consult a Philippine family lawyer to file the necessary court recognition!) ????
